Overview
Welcome to JST Kart Shop. The terms "we", "us" and "our" refer to JST Kart Shop Ltd. We run this store and website, including all related information, content, features, tools, products and services (the "Services"). Our store is powered by Shopify.

These terms and conditions, together with the policies they refer to (these "Terms"), set out your rights and responsibilities when you use the Services and buy from us. Please read them carefully.

By using the Services you agree to these Terms and our Privacy Policy. Nothing in these Terms affects your legal rights as a consumer, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013.

Experience Day bookings are covered by our separate Experience Day Booking Terms. If those terms and these Terms conflict for a booking, the Experience Day Booking Terms apply.

1. Access and account
You must be 18 or over to place an order. If you are under 18, a parent or guardian must place the order for you.

To buy from us you will be asked for information such as your email address, billing, payment and delivery details. Please make sure this information is correct, current and complete.

You are responsible for keeping your account login details secure and for activity on your account. You may not transfer your account to anyone else.

2. Our products
We try hard to describe and show our products accurately. Colours and appearance may look slightly different on your screen depending on your device and settings.

Manufacturer names and logos belong to their owners. Products described as "Essentials" are unbranded products sold under our own range name.

We may change product descriptions, discontinue products or limit the quantities we sell. This does not affect orders we have already accepted.

Some products, such as full-size karts and complete engines, are marked "Contact us to order". The price shown includes VAT, but these items can't be bought through the basket. Please contact us to confirm availability, specification, price and collection or delivery, and we will confirm the agreed details in writing before you pay.

3. Orders
When you place an order you are making an offer to buy. You will receive an email acknowledging your order, but this does not mean we have accepted it. Our contract with you starts when we email to confirm your order has been dispatched.

We may decline an order, for example if an item is out of stock, we can't deliver to your address, or there is an error in the price or description. If we do, we will tell you and refund any payment in full.

You can cancel most orders within 14 days of delivery and then return the goods within a further 14 days. Full details, including return costs, refunds and exceptions, are in our Refund Policy.

Our products are sold for personal and domestic use.

4. Prices and payment
All prices are in pounds sterling and include VAT at the current rate.

Delivery charges are shown before you pay and are set out in our Shipping Policy. The price you pay is the price shown when you place your order, and it will be set out in your order confirmation email.

We may offer promotions with their own terms. If a promotion's terms conflict with these Terms, the promotion's terms apply to that promotion.

Payment is taken when you place your order. Please make sure your payment details are correct and that you are authorised to use the payment method.

5. Delivery
We deliver to UK mainland addresses. Northern Ireland, the Scottish Highlands and islands are quotation only. Delivery charges, dispatch times and estimated delivery times are set out in our Shipping Policy. Delivery times are estimates and are not guaranteed.

The goods are our responsibility until they are delivered to you, or to someone you have asked us to deliver them to. You own the goods once we have received payment in full.

If a delay is caused by events outside our reasonable control, we will contact you as soon as possible and do what we can to reduce the delay. If the delay is likely to be substantial, you can cancel and receive a refund for anything you have paid for but not received.

6. Faulty or misdescribed goods
We are legally required to supply goods that are of satisfactory quality, fit for purpose and as described. If an item is faulty, incorrect or misdescribed, please contact us and we will put things right as set out in our Refund Policy. This does not affect your legal rights.

7. Using our products safely
Karting and motorsport carry a risk of injury. Many of our products are parts and safety equipment that must be fitted and used correctly. Please follow the manufacturer's instructions, check that parts are compatible with your kart or engine, and use a qualified person to fit them if you are not sure. Contact us before you buy if you need advice on fitment or sizing.

Safety equipment must meet the rules of the class or event you are taking part in. Please check those rules before buying.

8. Intellectual property
The content of our Services, including text, images, video, logos and the design of the website, belongs to JST Kart Shop or our licensors and is protected by copyright and other intellectual property laws. You may use the Services for your own personal, non-commercial use. You must not copy, republish or use our content for any other purpose without our written permission.

JST Kart Shop's name and logo are our trademarks. Shopify's name and logo are trademarks of Shopify. All other names and logos belong to their respective owners.

9. Third-party tools and links
The Services may include tools, content or links provided by third parties. We don't control these, and your use of them is subject to the third party's own terms. We are not responsible for third-party websites or for products and services bought from them.

10. Relationship with Shopify
JST Kart Shop is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with JST Kart Shop. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and JST Kart Shop, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with JST Kart Shop.

11. Privacy
We use your personal information as set out in our Privacy Policy. Some personal information may also be processed by Shopify under Shopify's Privacy Policy, because our store is hosted by Shopify.

12. Reviews and feedback
If you send us reviews, comments or suggestions, you allow us to use, reproduce and publish them in connection with our business. Please make sure anything you send is honest, lawful and your own, and does not infringe anyone else's rights. We may remove content that is unlawful, offensive or misleading.

13. Errors
Occasionally information on the Services may contain errors, for example in descriptions, prices, delivery charges or availability. We may correct errors at any time. If there is an obvious error in the price or description of an item you have ordered, we will contact you, and you can either go ahead at the correct price or description, or cancel for a full refund.

14. Prohibited uses
You may use the Services for lawful purposes only. You must not misuse the Services, for example by trying to gain unauthorised access, introducing viruses or malicious code, sending spam, impersonating others, scraping or copying content with automated tools, or interfering with the security or operation of the website. We may suspend or close an account that breaks these rules.

15. Agents
15.1 This section applies if you use or allow an Agent to access or interact with the Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity without direct supervision.

15.2 No Agent may access, use, or interact with the Services unless, at all times, it identifies itself and operates in strict accordance with section 15.4. No Agent may access, use, or interact with the Services if we have asked it not to.

15.3 We may limit, including by technical measures, whether and how any Agent accesses, uses, and interacts with the Services.

15.4 Agents must: (i) in all HTTP/HTTPS requests, identify that the request is from an Agent and disclose the name of the Agent by including the following in the request's user agent string: "Agent/[agent name]"; (ii) not conceal or obfuscate that any access, use, or interactions are from an Agent, such as by mimicking human behaviour or completing or circumventing CAPTCHAs or measures intended to distinguish computer use from humans; (iii) respond truthfully to any question or prompt seeking to determine if interactions are coming from a human or a computer; (iv) not circumvent or otherwise avoid any measure intended to block, limit, modify, or control whether and how Agents access, use, or interact with the Services.

16. Our responsibility to you
If we break these Terms or fail to use reasonable care and skill, we are responsible for loss or damage you suffer that is a foreseeable result. Loss or damage is foreseeable if it is obvious it will happen, or if both of us knew it might happen when the contract was made. We are not responsible for loss or damage that is not foreseeable.

We supply products for personal and domestic use. If you use them for commercial or business purposes, we are not responsible for loss of profit, loss of business or business interruption.

We do not exclude or limit our liability where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, and for breach of your legal rights in relation to the products, including the right to receive products that are as described, of satisfactory quality and fit for purpose.

We try to keep the website available and working properly, but we can't guarantee it will always be uninterrupted or error-free.

17. Termination
We may suspend or end your access to the Services if you break these Terms. This does not affect orders already accepted, your legal rights, or any amounts due for orders already placed.

18. Other important terms
If a court finds part of these Terms unlawful, the rest will continue in force.

If we don't enforce any of these Terms straight away, we can still enforce them later.

We may transfer our rights and obligations under these Terms to another organisation. We will tell you if this happens, and it will not affect your rights. You may only transfer your rights to someone else with our written agreement.

Headings are for convenience only and don't affect the meaning of these Terms.

19. Governing law
These Terms are governed by the law of England and Wales. You can bring legal proceedings in the courts of England and Wales. If you live in Scotland, you can bring proceedings in either the Scottish or the English courts. If you live in Northern Ireland, you can bring proceedings in either the Northern Irish or the English courts.

20. Changes to these terms
We may update these Terms from time to time. The latest version is always on this page. The Terms that apply to your order are the ones shown on our website when you placed it.
